I'm sure its a routine check as ur prev employer wudn't have notified USCIS that u have left them. Check with a popular attorney like Murthy or Khanna who may have come across such cases.

Every one keeps talking of "H1 Transfer" there is no such thing... every time someone files a H1 Petition on your behalf it is a new H1 Petition the only thing that changes is the length of the approval period. The period already used in previous H1b employments is deducted.
Now as far as the I94 and AP, as someone said earlier, when you use AP, you are parolled into the US. Similarly when you apply for H1 you get a new I94 along with the approval notice. This resets your status to H1b with I94 validity set to the length of approval period

I appreciate your enthusiasm. IV has directed all its members in the past to do what and when? They have also established a webfax mechanism and also asked IV members to contact the senators / congressmen. They have gone into the level of seperating statewise members and asking only certain state members to contact.
Once again I appreciate your thoughts. But the members should follow one direction and it should come from core IV. Do not do certain things without the consent from IV as it may back fire.
NOTE: What do you mean by contact woman? :D
Man/Woman, I see so much energy here or could be just shouting. It would be in the best interest to use the energy to contact respective congressman/woman/senator of their area, ask them / request them to bring/pass legislation like SKIL and PACE. Tell them why this bill is needed. Tell them your problem. If everyone of us call congressman and woman and follow up with them on the progress that would be great. Am I doing it? Yep..Not joking IV members are involved.
IV guys can you develop questionnaire which we should ask the operator. What I did is I asked to operator to connect me someone who can help me in bringing immigration legislation. That is how I approached the operator. IV associates what I am getting at is how should people reach right person? As IV people have interacted with many senator office they have better idea what are different staffer there and how they are addressed, and how to reach them.
Let me know what are people thought? I think instead of wasting time, lets get to work. Help yourself by calling senator/congressman/woman. And this is oppurtune time.

This is a great point. Even if we get one time relief,that should suffice because retro might not happen in the future as there will not be 245si/195kH1bs. I hope one of the core group members might want to look at this. This will atleast counteract the exaggerated and bloated immigration numbers by the antiimmigrant groups.
It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract

I called my attorney after seeing this thread. This is what I heard from him.
We have not received it back from CIS. We have not received any of them back that we filed. CIS said it will unequivocally reject them. But as of Monday they have decided not to send some back (many were already sent back) pending some internal decision-making about how to handle them. We would let you know if anything happened.

Hardwork of immigrants is the bedrock of American society. If seen in that light it makes perfect sense. "We deserve," this thought also ties into the Pygmalion theory. That is the American way. This is not a collective but an individualistic society, unless you showcase your achievments they won't be fully acknowledged. Unless you show that you deserve nobody is going to give it to you.
On another note, I give my example, I changed my job last year and relocated. I don't work for a consultant either. My earlier priority date was Sept. 2002 but I was willing to make a move and not be held hostage to retrogression. I knew it would be tough and many of my friends on H1-B thought it was a bad decision. Atleast, now I won't regret not making a decision. This maybe an isolated example but my old employer hired two American workers to replace me. Maybe its because we work harder or maybe because its both, smarter and harder. As JFK said,"We want to go to the Moon not because it is eazy but because it is hard." We deserve as much as born citizens if not more based on our contribution to this great nation of immigrants.

Here is one scheme I have been thinking about:
1. Every week members donate any amount they like over paypal
2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.
e.g.
consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100
________
Total: $390
Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90
What IV received in the process: $390- $90 = $300
The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!

I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......
That is so TRUE! Ask me I finished my undergraduate from US, and I didn't get selected in the H1 lottery system 3 times, yes 3 times. Neither my wife's labor was cleared in July fiasco. So imagine my situation.
So,
who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.

Please continue to follow up, and in the meantime, send a letter to everyone you can (senator/USCIS sec./first lady/go for Infopass).
Edit: Forgot to mention, please print out the email response from CIS Ombudsman and put it as a supporting document when you send your case details to USCIS Sec. and others. Any response you get from USCIS, you should put it as a supporting document when you send your case details to higher authorities.

It's not just 180 daysd before the application, it also includes 180 days AFTER the application.
This is the current section on 90 days period
(E)(i) In the case of an application described in clause (ii),
the employer did not displace and will not displace a United States
worker (as defined in paragraph (4)) employed by the employer within
the period beginning 90 days before and ending 90 days after the
date of filing of any visa petition supported by the application.
And the ammendment in the new bill
(1) NONDISPLACEMENT.--Subparagraph (E) of such section 212(n)(1) is amended--
(A) in clause (i)--
(i) by striking ``90 days'' both places it appears and inserting ``180 days'';

But yes, this applies AFTER 180 days as well.

whatever the case is, this guy is doing it legally. Granted, he is taking advantage of the loop hole in the system. HOWEVER, it is legal. Trust me, we have taken advantage of several similar system loops holes in our lives.

those who are defending IV has more green dots coz, they are the ones who do all the volunteer work and involve actively.

IV has to priorotize before going to a lobbyist, with very very few contributions made, its very difficult to have everything bundled into a single request.
Its also unfair that L1 has to work for specific company but L1 spouces can work for any company any job, its so funny, when you think H1 has to work for specfic company and only for specfic job, but spouces can work for any compnay any job any salary without any labor department intervention
Immmigration awareness has increased a lot among US voters, when it comes to threat of their jobs being lost, and democratic senators are very much aware of it, hence CIR is no longer their priority.
I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surpired today since nothing was ever said regarding no interest in the H-4 cause when many discussion were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributer to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT spouses folks.
