While i am like everyone else in the fact that i want my GC i am not a selfish/greedy person (Like some of the members here on IV) who wants their GC at the expense of someone else
EB3 dates 2 years behind EB2 dates sounds resonable and if that ratio is kept then it will be beneficial to everyone. Not the way it is now.
What i want to see happen is that EB3 move to Aug 2004 dates while EB2 is at Aug 2006 keeping a 2 year difference between them, and maintaining the samne ratio moving forward

My analysis if the law is passed in the current form
1. Non displacement provision will delay H1b process. But innovation will not be impacted as best companies Like Google, Microsoft and start up companies will not have a problem in proving that skills are not available in the market.
2. When a company lays off they cannot recruit for 6 months. But a company is laying off people they will hardly recruit for 6 months. Generally when they do less than 5% of staff that will not come under layoff provision and still they can recruit H1b. So only a few positions will be impacted.
3. 50% rule may make many bodyshoppers and Top indian companies force to recruit US Citizens and medium non public companies may split into many companies. Some H1b dependent small and medium companies may go out of business. It will have huge short term impact on H1b aspirants but they will adjust quickly to change their jobs.
4. More powers for DOL will make the companies to follow the law and reduction of abuse
5. Of course the restrictions will make less number of jobs for H1bs and L1s. But when economy improves demand will increase so that H1b cap will be reached inspite of all these restrictions. I strongly believe that system will adjust the new restrictions similar to TARP bill but short term very high impact. But that can be minimised by applying all those restrictions only for new H1bs. Generally more restrictions the persons qualifying will be best and bright and also wages for H1bs,L1s also will increase with improved working conditions.
6. If pro immigrants like IV can negotiate to include Recapture or increase GC cap. But that depends on chance of passing the bill. If IV and other pro immigrants lobby and block the bill then that makes sense. But if the bill gets bi partisan support then it may be wise to take different approach. This bill may be like 2007 and may not be considered at all.
I did not read the bill completely but my views were based on some major provisions and also I do not believe the conspiracy thoeries that they want to remove the H1b program first then EAD then GCs. But it is a protection for US citizens. I am not arguing that the protection is right or wrong but most countries in the world are trying to do that when recession. India has 100% protection for jobs for Indian citizens

Folks who had delays in getting H1b stamped due to the PIMS verification at Chennai Consualte:
Can you look at your H1b approval notice (i.e. I-797) and see if there was an A number (something like A123 456 789) mentioned under the "Beneficiary" box?

Are you sure your namecheck is pending? How?
Do you have any written proof?
If there is no arrest record or any suspicious item in your application, your application may have been picked up randomly for interview. IV had worked on Namecheck issue in the past and namechecks should not be taking more than 6 months except very very few cases.

bought AIG insurance..twice, my dad had severe hand pain and could not take him to a doctor, cos, the docs wont accept visitors medical insurance without a cash deposit. then i tried to get pre-certification from AIG, for which they would not give it, so its a catch 22...so screw it, even if ur parents fall sick, all of a sudden when they are in the US, take them to the emergency, there is no system in place for medical insurance for visitors, every other insurance is a scam..so dont even have any hopes..just do what u need to do..there are lots of times, this country does not allow us to live more than 6 years being on h1 without a freakin green card, we have paid lots and lots of taxes which we will never claim..so, this is how they repay.

I voted for both questions.
BTW Sen. McCain is now front runner in GOP for presidential candidate. Even though he backed out of immigration reform, I consider him our friend and also a person of integrity. I am glad to see him emerge as front runner. On the other hand Tom Tancredo figured nowhere, even when immigration was still hot issue. That should be enough for our friends in NumbersUSA & ALIPAC to see where they stand in terms of public support for their issues.

I dont think it's a good idea. The fundraising thread demonstrates that we do have people who understand the stakes and are willing to do something about it. Ofcourse we need a lot more money but we should be able to persuade people to contribute voluntarily. I don't like exclusive clubs

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
Lets target the 'Asses' asking for a kick. Let's all kick ass.

It won't help, if everyone starts porting, EB-2 queue will face a similar situation. Porting doesn't happen soon either. With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.
Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,
If you stay in EB3-I then you are the last one to get the VISA. If you port it to EB2-I then you put EB3-ROW behind and you get in line first in EB2-I bcoz you will have older PD.

I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......
