Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Mr chaanakya, You may find this as a personal attack! But it is not. This is an attack on your thought process!
You claim that you received a PHD. But I seriously doubt whether the university that decorated you with a PHD evaluated your ability to think rationally and ability to reason!
Normally with education people achieve wisdom, knowledge, ability for rational thinking, ability to reason, humility, compassion and a better understanding of the functioning of the world.
I am not saying you do not have the right to complain or right to protest. You have and you definitely should have. But the approach that you have taken is the wrong one! In your post you criticize about people lamenting their plight! In reality, you are also doing the same, Am I correct?
If you are a real PHD, just go through the following post that you presented and analyze how you can improve that to make it a product from a REAL PHD!
If such an educated guy like you can become an opportunist, how you can expect higher standards from lesser mortals!
In another post you said that you were eligible for EB1 and couldn't go through that rout, are you lamenting here? If you are well qualified, why didn't you go through that rout?

So, my friend, nothing gives you a right to be here or to get GC. It is a privilege.
You need to understand one thing: Each person has different skills, living circumstances, responsibilities, and different type of blessing from the almighty. So, don't measure everyone with the same yard stick that you are using to measure and don't use your own selfmade standards.
If undocumented immigrants where also competing with you for a GC spot, you would have said, they also have the same opportunity here, why they are not taking masters and PHD to get their GCs sooner?
In reality, some are fortunate to reach your level, but not everyone! But that doesn't make them ineligible for the Pursuit of Happiness and Pursuit of a better life!
If you do have a real PHD, you should lead, you should be a role model for many and propel your energy in the positive direction instead of a stupid post like this! You can work to make things better in this country!

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

I do agree that my success (both personal and professional) depends on:
1) Ability to file I-485 so my wife can start working. She has a MS in Computer Science degree which she acquired while on H4, which in an itself is a major accomplishment. But, she can't do much beyond this. Lots of employers stay away from filing H1 these days. So her best bet is get EAD soon so she can start working.
2) Ability to file I-485 gives the benefit of visa-stamp-less travel. We've been postponing traveling to India due to the hassles involved in H1 stamping.
3) Ability to get greencard will give us peace of mind for sure.
I do know IV is working to reduce backlogs, remove per-country quota, admin fixes, and much more. I do not of any other platform that is helping employment based immigrants...which is why I'm participating in the advocacy days and I just contributed $100 towards the cause.
I hope IV slowly but surely gets enough mass of people to become a self-sustaining organization that can make impact to the lives of immigrants. You and other IV volunteers are surely doing a great job.

So do you think they are going after AC21 folks as a scapegoat? I spoke to few people on this including lawyers and they say that "denials on 485" when 140 gets revoked is a common thing and usually the officer who issues the denial letter does not check and verify to see other details. Thats why they have to go through the MTR process.
That was the case when uscis would send straight denial and then person would do mtr with ac21.
the OP and the particular case I am talking about; they responded to the notice of intent to deny (NOID specifcally said person may be elgiible for ac21 and to give job letter, etc.); however they denied it after the response was sent. It would be different story if they denied due to job mismatching. However, that was not the case. They denied stating the 140 was revoked. Basically, this is a new type of denial and may be a shift in how uscis is doing things.
I spoke to candidate earlier and he talked to the original 140 company. They told him that their h-1b's aren't getting approved (common issue right now with vermont service center for just about everyone) and that in the clean up they revoked almost 70 I-140's for people who had left. He doesn't know if it was in response to an I-140 query or not (uscis adds up cases frequently in rfe's on the 140). When companies revoke 140 to a RFE; USCIS could be making a determination that the 140's company is now revoking were approved iun error and people are not eligible for ac21. Now; if this was the case; uscis officer should have put this in the denial but they did not.
I'll keep everyone posted of what happens to this case.

If you feel you are offended or prejudiced, why not pursue a lawsuit for defamation/moral damages? I think this is perfectly fit for a judge to decide. Only this way the small can affect the big.
Or, why not try to appear on the show and talk against the lies Tancredo said? I bet Lou Dobbs would love that, as it would increase audience.
A petition like this, directly to CNN, is, in my point of view, a waste of time and effort. It's not going to be read and will be thrown into the trash can as soon as it is opened there.
Defamation is hard to prove without Lou Dobbs having singled out a particular individual or company. Lou Dobbs is hiding behind the first ammendment and he obviously knows that. However if someone is harmed, profiled or attacked because of being a H1-B holder and the perpetrator was influenced by Lou Dobbs there could be a case for recovery of damages. Lou Dobbs has been burned before by guests who have argued against his rhetoric, incase you have noticed, majority of his guests are almost 100% in full agreement with his principles thus hopes on appearing on his show are minimal at best.
Petitions and letters to CNN if delivered through the appropriate mode eg fedex will be read. If CNN decides to ignore the letter then they can only blame themselves when advertisers are the next target. No company would want to be associated with the sponsorship of bigotry or hatred.

I-140 on 6/07 & pending
I-485 arrived to NSC july-1st @10:10 pm
status unknown.
My lawyer sent me the fedex tracking sheet for the I-485 package sent to:
USCIS
Nebraska Service Center
850 S Street
Lincoln, NE 68508
I did not see any PO Box on the Fedex tracking sheet. I am not sure if she put the PO Box on the shipping label or not??
Is it a big deal?? Will my application be accepted.

It is hard to believe that someone can suddenly change policy internally and not talk about it. In my case the officer id who issued denial is different from the officer id who issued NOID.
UNITEDNATIONS - for some reason, I think you are trying to spread unnecessary fear with your conspiracy theories. Agreed that USCIS is going tough on consulting companies and that stuff, but "internal policy change" seems to be more of a conspiracy.
UN probably didn't realize that the officer id. was different. The id. being different is a good thing, it makes the likelihood of the IO not having noticed the old NOID higher.
I am sure you are under a lot of stress, and I feel your pain, but click on UN's profile and look at his old posts carefully, he knows what he is talking about.

[harikris] Plan B/C comes into play when plan A is logically terminated. That is not the case here Mr. Brown. The process should be fast enough not to allow a life changing event to weigh in on any individual to continue with an initially chosen plan or to abandon it.
[Mr. Brown] Given the passage of time priorities/drive should be geared more towards securing and making the best of what you have (home country's citizenship) rather than what you don't have (GC). Heck, even retirement based mutual funds work in that fashion (aggressive at first, conservative as time passes).
[harikris] Going by your analogy, most "young" folks do play it aggressive(risky) by following up on their dreams and when it is time to consolidate/secure, they are facing uncertainties that are not quite under their control. I can assure you that all their efforts are indeed geared up towards securing what they have worked so hard for all along. I am assuming home country's citizenship and social circles are a given and no extra-ordinary effort needs to be applied in those sectors.

It seems like any change in the immigration system is only going to land us in a worst position than we are in....
And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.
Any noise we make seems to be making our opponents solidify and press us even harder.
I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

I agree and actually this is a time wasting thread. it is good that he got this citizenship and I guess he is happy but what about others who are struggling to get a gc? and this statement really irritated me "I know, the wait time is long, but it is worth it every bit."
maybe they should make new citizens apply for passport every year and tell them to renew DL every year and after few years I will ask him if the wait was worth it ??
I will still say "it is worth it". This is my opinion and you certainly can have a different opinion.
If you think that the GC is not worth the wait then I suggest that you withdraw your I-485 application asap. ;)

I won't like to take names on public forum of the Congress members we have/will approach. But to answer you question, we are taking all necessary steps to make this walk a success. Also, the measure of success will be a large turn-out by legals to protest, which in itself is unprecedented. We won't like to marry the success of this protest with the presence of any particular Congress member or Senator at this time. The bottomline is, media coverage for our issue.
