Thanks for your response. I have not tried the infopass yet. But my PD is not current and will that be an issue for scheduling an Infopass apointment.
Also, is Infopass same as Service Request (SR).

(a) That could be tough, but check with your attorney. Or check if you or your husband's company has any unused LCs. Remember that LC substituion can be done only until July 17th (could be 16 or 18th, please get this confirmed), so you have to act fast.
(b) No.
(c) No. I am almost sure even if you have an approved I-140, it still isn't enough to get an H-1B extension. Your best bet would be to work on an EAD if you were eligible to apply for 485. Talk to your attorney.

Only problem with H4 is they cnt get OPT after finishing the degree. Also they cant get any job on campus like F1's can.

Hi Travellertvr! Since your extension came with a new I-94, your problems are solved automatically. There is no need for you to go out of country and come back either. As of now you are a legal resident here period.

Guys,
I was laid off few weeks ago and my I-485 is pending for over 180 days. I have a potential offer from a company and I was planning to port my I-140 using AC21. My GC sponsoring employer had listed the position requiring Masters degree and my I-140 says EB2 as someone mentioned in the previous post.
The new offer that I am getting may not require Masters degree but it may require BS+6 years of experience. Will this be considered EB2 port ? I am not sure about this because this position requires BS +5 , which can also be considered as Eb2. As I am on timeline (my dates will be current as per Aug bulletin) I want to have job offer in hand so I cannot be picky about the position requirement at this time.

Hi Guys,
My experience with driver's license renewal in Ohio with EAD/expired-H1 was a pleasant surprise.
All I said was that I was a green card applicant, showed them my I-485 application receipt, and got a license valid for 4 years.
Smooth. What a surprise.
not sure what city you got in, but I was in Ohio for 7 yrs and never got 4 years, I got only until I94 or EAD exp date..mine was in cleveland...

Do it yourself & do not depend on your lawyer. Call them. I filed in Aug'05 & got it in 45 days. I used to call their IT guy in DC office & he was very prompt in fixing issues ( which could be IT related)

If spouse apply for Social Security card, will she lose her H4 status. Or the status changes after she starts using the EAD for work.

what has indian immigration officer to do with AP and US immagration.....
You need to show the police officer in India before leaving for US that you have valid visa/papers to enter US. Otherwise I suppose they can stop you from boarding.

You cannot become a Canadian Citizen, just because you are on H1 in the US. The only advantage is you can apply for Permanent Residency from the US, which is much faster than applying from India. Once, you get your Green Card, you still should maintain residency in Canda, before you apply for Citizenship.
Ria, You can apply for Canadian Permanent Residency by urself. You dont need to hire people to do it. I did it by myself, and it is very easy.

What is legally considered as "Permanent Residency approval date" - is it the approval of I485/getting greencard or is it the approval of I140. Sometimes the I140 referred to as an immigrant petition. As we know the process is once this immigrant petition (I14) is approved we apply for adjustment of status as a permanent resident thru II485 - so legally - can we consider that until I485 is not approved, our permanent residence applicaiton is pending?
If you read the back of the approval of the I-140. It says:
APPROVAL OF AN IMMIGRANT PETITION
Approval of an immigrant petition does not convey any right or status. The approval petition simply establishes a basis upon which the person you filed for can apply for an immigrant or fiance(e) visa or for adjustment of status.

Working on "loss of pay" means you are still on the pay roll but cannot sustain keeping up your responsibilities of your job. You are still in status. People who go to home country for visa validation, when get struck there, are supposed to be at "loss of pay" but still on the job; that is the reason they get the visa stamps and come back. If they go into out of status, they wouldn't have gotten the visa stamp. This has happened to a few people from India and China that I know of a couple of years back.
Vacation could be taken under such an understanding with your HR.
