I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.
Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.
What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.
Any comments are really appriciated.

Hi,
My husband is having L1A visa through company X.
Howmany days/moths/years will it take for us to get GREENCARD if we apply in MAY2008.
I understood no LC is required for L1A visa holders Greencard processing.

This if u sent your packet by US postal mail . Fedex and other courier dont deliver to PO boxes . There is another street address for other courier.
Thanks Milind70 for the reply , yes I did use USPS because the the IO told me to send my 485 package to the address shown on I140 receipt and Fedex does not deliver mail at P.O box. I am wondering if the P.O Box address is right and should i wait for 90 days or call them based on Lockbox receipting update bec as per Aug10th release TSC shows done receipting till June 28th? Is there a way to inquire regarding my application?

In FY 06, over 10,000 visas were lost because of slow processing of EB cases, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards. As of May 2007, the
State Department estimated that 40,000 EB visas may be lost in FY 07 if USCIS does not increase the
processing rate for green card applications. The Ombudsman attributes the slow rate of adjudications to inaccurate statistics and inefficient USCIS management of its workload. The problem will become significant in the coming fiscal year if there is a dramatic increase in EB green card applications, and a significant backlog is likely to develop if this problem goes unaddressed.

H1-B Extension after 6 years.
Is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?
I have changed my employment after I-140 approved. But the previous employer agreed to continue the GC process. I could not file 485 due to PD is not current.
The 6 yrs limit on H1 is about to be over.
Is it possible to extend H1-B after 6 yrs at the new employer, based on the I-140 approved by previous employer as green card is process? Or is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?

In order to extend H1B beyond six years, you do not require to be with the GC sponsoring employer. One must have filed a labor 365 days before 6th year end date. 1 or 3 years extension is based on what stage of GC processing you are in. Hope this helps!

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??

My case was filed in EB-3 category (August 2003). I completed a doctorate in 2007. I am thinking of filing in EB-1 and EB-2. Can anyone help me with links for preparing these applications and some dos and donts? Also is there any way to recapture my earlier PD (Aug 2003) for the current filing? Thanks for your help.

Yes I have known people done for H1 and H4 both. My friend who was fron MP usually get his H1 from Mumbai. But Last year he got his H1 stamped from Delhi just because he wants to go to Honeymoon there. Hope this helps.

I need some clarification/suggestion regarding my status.
I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. I am still continuing on my H1-B without using EAD. We are planning to go to India in Dec and I prefer to use my AP while entering US and would like to continue working on my H1 (continue with same employer) after coming back. Is it possible and valid to do like that? If its ok, do I need to submit any form or anything to USCIS informing that. I prefer not to use EAD. Hope I am clear explaining my situation. Please suggest.

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.
