I partially agree with you. Btw, not all students have to prove that they would not work in US. Actually, my interview was fairly simple and pretty hilarious(that's a different story).
US law offers student 1 year OPT to gain experience and find employment. If the intention of the country was to deny/discourage employment to students then OPT would cease to exist. Also, the H1-B application would be rejected if they wanted to implement the rule, which they clearly don't. Again, that is a loophole. I had to submit a copy of my degree, transcripts etc. because my job required MS + 1.
In your opinion, would it be cool if a MS graduate moves back to India, gets a job offer in US (that qualifies for EB-2) and then moves back to US?

DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.

My PD is Dec 2005. I have 2 more years of valid H1B visa time.
Lets assume that I apply for my 485 in a month or two and that I get my EAD by november. I hunt for my "right" partner and get married after november and I plan to get bring her to US of A... here are my Q's
1) Is my H1 going to be valid after I get my EAD approved?

Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

When you join a state chapter or a group in your area, it is not necessary to conduct face-to-face meetings everyday/every week, although in person meetings wouldn't hurt. The idea is to create a channel to dissipate information through channels other than WWW. Believe it or not, there are lot many folks from anti-groups who lurk around just to keep an eye on us. Participating or becoming part of the group near to you and encourage others to do the same will also help to build/strength a group of like minded folks in the area who could then team-up to meet with local lawmakers from your area/state. We are a grass roots organization and we need to have a stronger grassroots in order to continue to be more effective. As I said earlier, this channel also is very useful to dissipate information which cannot be shared on world wide web.
Now a days when everybody has presidential election on their mind, immigration issue is not on the list of things to do for most lawmakers. As such, it takes time for the updates and the there are updates that cannot be disclosed on www. We continue to work on our issues in manner we have always worked in the past. And in the absence of Congress not taking up our immigration issues, it some how becomes our fault even though it is ok if some folks would show up from time to time and suggest that they have reasons not to join a google or a yahoo group. And all of a sudden the problem is with organization and the manner in which we work and then there is an urgent to create a �process�. Had it been the year like 1999 with all the efforts from IV, I am defintely sure the CIR reforms would have passed by now.
Issue here is the economy, recession looming large on our face, unemployment level rising, and no one knows whats going to happen in the next two-three years becuase of credit crisis and oil price going above the roof. If this continues for another year, we will be in deep s***.
Thats why no will dare to increase the workforce by issuing more grren cards. Atleast we should feel happy that they havent stopped issuing the cards.
I know its painful to be waiting for years to get a GC. But you do not know how green that card will stay if the current financial crisis continues for 2-3 years.
Fact is, this country is going thru a difficult period of uncertainty. Because of election year rhetoric, no one is going to accept it. But clearly, its not in their interest to get more workforce into this country. They know we have been waiting, and will continue to wait. Look at 2002/2003/2004, when they issued only 20K visas for the entire year. So just hope that things will get bright for this country soon else, we are in for an another hell ride.
Why they are bringing the people on the Lottery. They give 50,000 green cards each year thru lottery system. 50,000 and inlcuding dependents atleast 2 = 150,000 people come. In addition this they give asylum to around 200,000-500,000 people. They come here and start from scratch.
Most of H1B(s) are working here and estabished. If USCIS gives green card to H1B(s), it will not create any problem to the labor market. Infact it will give boost up to economy because people who get GC, they will start buying houses, luxary items and other investment to this country.

IV has to priorotize before going to a lobbyist, with very very few contributions made, its very difficult to have everything bundled into a single request.
Its also unfair that L1 has to work for specific company but L1 spouces can work for any company any job, its so funny, when you think H1 has to work for specfic company and only for specfic job, but spouces can work for any compnay any job any salary without any labor department intervention
Immmigration awareness has increased a lot among US voters, when it comes to threat of their jobs being lost, and democratic senators are very much aware of it, hence CIR is no longer their priority.
I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surpired today since nothing was ever said regarding no interest in the H-4 cause when many discussion were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributer to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT spouses folks.

I am have been on /off with my pay roll’s. I am still with my Green card sponsored company.
It’s almost 9 months since i got my GC. At the time of citizenship
How does USCIS verify the length of stay with the petition employer? Are they going to see the pay stubs or Length of the stay or a letter from employer….

Sorry I missed your question before. My take on your situation is that you are good, and do not worry too much about USCIS's way of doing things. Did your company serve you any temporary suspension/reinstatement notice(s) coinciding with these payroll gaps? If not, and I would guess not (because that would reflect poorly on the company's health), your story means that as per your original employment letter, you have been with your employer continuously for 9 months after GC, and presumably longer (you did not say about any plan of leaving them soon), even though you are not being paid regularly. If anything, such payroll discontinuity should help establish your intention of remaining with your employer despite the hardship, if this issue comes up during citizenship interview. On your part, you should keep a detailed log of the dates you missed payments, in addition to all relevant papers (this goes back to DO item #3 in my list).

But if there are complicating factors, like your payroll gaps, and if USCIS comes to know about them (e.g. you tell them), they may ask your company to furnish evidence of payment history, such as copies of all relevant pay stubs (a simple letter from your employer may not suffice).
Chin up, please. You have your GC, which already makes you privileged compared to so many deserving folks still waiting long and hard. So, go hit the pub, shoot some pool, smell a rose, call up your fiance(e), take family on a Bahama cruise, tweak your boss's nose, kick some butt, write a(nother) check to IV, or whatever it is that you use as a release mechanism from such unnecessary tension :)

What exactly do you mean when you say starting this business? Do you want to open a trading account on your own and trade? Join a day trading firm? Or open a Fund? Each one will have different implications on H1. You can open your own investment account with a brokerage firm and trade your own money, no problem with H1 what so ever.
If you join a day trading firm you will have to be on H1 with them. Very few ones do but I know of a couple who will do it. In fact a classmate of mine is working as a Trader/Analyst with a small trading firm in NYC. They have sponsored his H1.
Starting a fund, (if you can get the seed money :D), you open a LLC and sponsor yourself. You will be an employee of the company and draw a salary. You tell me what you have in mind and I will tell you what to do or what I did.

For India/China both EB-2 and EB-3 are heavily backlogged and unless the new administration recaptures lost visa numbers due to bureacracy, it will be
impossible to catchup the old backlog pending since 2001.

One step closer.
With last year crisscrossing, EB2 India most apps are cleared upto september 2004. We should not have too many in 2004 except substitution cases.
Hope it will step into 2005 in next 4 months....

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?
Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)
