    We are in the midst of the �Great Recession� and U.S. industry is struggling to remain competitive. While the law requires U.S. employers to verify, through a specific process, the identity and work authorization eligibility of all individuals, whether U.S. citizens or otherwise, it is practically impossible to obtain legal status for employers who discover undocumented workers in their workforce � even if they have been employed for decades. Many employers are surprised when told the law requires ALL employers to complete an Employment Verification Form I-9 for any new employee hired after November 6, 1986, or face huge civil fines, and possible jail sentences. The I-9 Employee Verification form must be completed within three days of hire for all hires including U.S. citizens.

    Vigorously enforcing this law without providing employers any way to keep essential workers puts employers struggling to make ends meet with the possibility of receiving huge fines, and even prison sentences if they "knowing continuing to hire five or more workers." Actual knowledge of the undocumented worker's status isn't always required, and "constructive knowledge" will suffice where the employer "should have known" of the worker's status. For example, if the employer tries to sponsor an undocumented worker for immigration benefits, the employer is presumed to know of the workers lack of immigration status.     No problem with expired i-94. Just inform them about I-485 filing. I did it without any problem.

    Do you guys see any issues if I-94 is expired but I-485 application is pending and the petitioner is working on EAD? Any thoughts will be appreciated. Thanks,

    Folks,
    I am due for an EAD renewal. However, my I-485 Receipt Notice got lost in mail. :(

    Can I still e-file. A lot of you said, we have to send a copy of the receipt notice as a supporting document. Can I do without it.

    Any pointers would be really appreciated.

    This is disheartening...

    Don't be. You will be current in Oct and I believe going forward (chances of retrogressing to 2005 is very slim if at all there is any retrogression).

    That said, don't wait for USCIS. Be proactive and do all you can. I would suggest

    1. Calling the USCIS customer service (get hold of level 2 rep by telling the level 1 your case is outside normal processing time) and try to get the status of your case. Might take few tries before you can get some info.
    2. Open an SR.
    3. Do the above for your dependents if any.
    4. Make infopass (you have already done this).
    5. Contact local congress man/woman.
    6. Send mail to CIS Ombudsman
    7. If your security check is not cleared yet, you can contact FBI (by phone) and find out the status.

    (more information on all these can be gotten from simple google search. If not, post here and some one here should be able to help you.)

    I m on h1b and my I485 application is pending. Also i have recieved EAD valid till Sept 2010. I m on H1 Visa status with current company. if i get laid off, how do i move my status from H1 to EAD after layoff?

    I m planning to take 2 or 3 months break if i get layoff and then plan to find another job on EAD. Is there any problem to assume ,my status will be automatically change to EAD if i get layoff while on h1.

    There are situations when a h1b transfer or extension is granted but the approval notice does not have a i 94 atttachment that adjusts your extension to stay till the end of your petition date. In such a situation, the benificiary has to go to his home country for stamping and then come back.

    I have created this thread to communicate and track MI chapter activities on creation of eGroups to serve the needs of the MI chapter

    1) Data on 10/20 meet has been compiled and documented. Minutes of the Meeting will be provided to the attendees soon through a secure eGroup (files/document section)

    2) Work in progress to provide a secure, trusted E-group which provides the best features available to our community. Pilot groups have been created in Yahoo and Google to study the features, ease of use and ease of management (for the mods).

    Results so far

    Google

    Pros :

    1) New.
    2) Has stacked thread view similar to Gmail.
    3) Ease of use (not much functionality to confuse users).
    4) Supports HTML pages and also commenting on those pages. Google search available to search the threads.
    5) New, hence not blocked in many offices ( esp mine :))

    Cons :

    1) Buggiest of the three! (I created a 'Restricted' group. None of the links are working)
    2) Key features such a Polls, Database missing.
    3) Limited management options.

    Yahoo
    ---------

    Pros :

    1) Stable
    2) Lots of management options. Powerful
    3) Powerful member features - Polls, Database

    Cons:

    1) Old/dated
    2) Text only ( unless you send E-mails externally)
    3) Options could be overwhelming to a new user!
    4) Blocked in many offices ( E-mails can still be received. Other features like Polls, Database need to be accessed from home)

    Right now, per my experience so far - Yahoo seems the best option. Let me know your ideas.

    And once we decide on a platform

    1) I need 2-3 days to setup the group to meet groups needs and expectations.
    2) MI meet attendees will be sent invitations to join the group.
    3) Others who responded to the Meet invitation but couldn't attend will be contacted to check if they wish to join the group
    4) MI chapter eGroups successfully launched!

    Folks,

    Need a little advice. We (my husband and I) filed our 485 on July 2 under EB-3and have received AP, EAD, FP etc. Our PD date (July 7, 2001) got current in the March bulletin:). I wanted to check if there is way to find out if our cases have been adjudicated and are ready for approval as and when a visa # is allocated in March.

    Looks like this is only for renewals

    A colleague of mine (not India or China) got her EAD card in mail within a month of applying. Her 485 has been pending for more than a year.
    Another friend of mine from India got his approved within 60 days of applying.

    Doesn't all these mean that the interim EAD (or whatever you want to call it) is still possible and we can get it?

    I am confused.

    I though such contracts are illegal in US?....It is employment at will.....that means they can kick you out anytime or you can leave anytime....maybe someone can clarify
    It is "at will". But employers can have what is known as a "termination" clause. This clause can be anything (as long as it is legal):
    - You cannot quit and join a competitor within 2 yrs
    - You have to return all money paid for relocation if you quit within one yr
    - You have to pay all costs associated with GC processing if you quit within 2 yrs

    It looks like "2 yrs" is the max. time allowed by the law.

    As long as the terms are reasonable, it will stand in the court of law. However, stuff like "you cannot do any programming for 2 yrs after quitting" will not hold in the court of law, because the agreement is preventing you from earning a livelyhood - which is illegal.

    As others have already mentioned each state has a different rule. Based on your state, you may be eligible for unemployment benefits. But what is more important is that now you are saying you do not have a job by claiming unemployment. Green Cards are for future job. If you are on unemployment compensation, how would you prove your eligibility for green card if questioned.

    Dependent family members can avail unemployment without much concern of jeopardizing their Green Card.
