    And that's never gonna happen. All Green Card seekers have stopped filing in EB-3, they are somehow managing to file in EB-2 by hook or by crook. So until congress changes any Law, every single spill over visa will be consumed by EB-2s and EB-3 India is not going to get a single spill over Visa...
    1. I don't see any chances of getting any spill overs in the next two years.

    2. There are only 3000 visas available for EB3-I in any given year (7% of EB3 quota). EB3-I will get few more if and when EB3-ROW gets current.

    I am not able to start and feel that there is already hidden membership is there. Is there any thuth in this feeling? How does IV is working in terms of access rights?

    IV is already not member friendly. With 25,000 members, raising 30,000 is getting so difficult. Why so? I once posed the question and moderators conveniently deleted it.

    We collected 30,000 in eight days. I would not call that so difficult...

    Sure it could have been better... but thats the question members should ask themselves, not the CORE or the volunteers.

    Hi
    Today I have seen soft lud on my 485 application, My pd is dec06 eb2-India, I have called uscis IO she updated my address and she told me that they are waiting for visa number once visa number is available they are working on my case, I asked her why I got soft LUD, she replied that IO opened my file and find out that country VISA number is not available. Because they touch my file I got soft LUd.

    Try from american company. One of my friend had problems with claims when bought insurance from K.V Rao.

    Any insurance is fine if you are not claiming. The real trouble comes, when you need to use the insurance & claim money back.

    No insurance covers pre-existing condition

    its a short sighted approach, you will just move from one level of pain to another one...once you realize that you are stuck with no change in job 'status' for 10 odd years you will realize that AC21 is not all that great...ihmo..i agree with you on the SKILL bill

    I agree with you guys...especially even if they permit 485 filing pending the priority date...it will help a whole lot of people get out of their employer's tyrannical grip and lead a free life.....:) ...I only hope the SKIL bill gets passed in some way sooner.....

    I hope you are not kidding...i feel so guilty now...i posted this to the CORE on another thread..

    "guys..Could you pls let us know why we have 100 as the minimum amount for contribution...i also noticed that the recurring contribution is 50 instead of the usual 20. Guys dont get me wrong. I wanted to call up my friends and ask them to contribute for IV...but i guess we should let them decide the minimum amount...or atleast have 50 and 20 as the minimum and recurring contrubutions respectively...I myself wanted to sigh up for the recurring contribution...but 50 every month hits me on my face..

    No. It's not a typo. I had met Aman in a conference in December. He was talking about selling his house to contribute to IV (I really hope he didn't have to). But he has contributed a small fortune to this effort.

    AFAIK, once you work on EAD, you can not be back on H1B. Please check this with your lawyer.

    However what I do not know, and what my lawyer also could not answer till this point is, if after travelling abroad using AP, can one transfer same H1 to a new employer? I know it is possible to continue working on H1 with the same employer. But what if one need H1 transfer?

    Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.

    6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

    I-140: Approval April 2006
    I-485 -May 2006
    Finger Printing: June 2006

    It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....

    Any suggestion in this regard is highly appreciated !!!!

    Your application may be just sitting in their shelf because of name hits. The "in process" letter that FBI sends doesn't indicate much. Depending on how popular one's name is one might be in the namecheck hole for 4+ years.

    There is Buy Rate and a Sell Rate. The Buy rate is about 50-60 Cents less than the Sell rate. You get the buy rate when you send money...

    I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.

    It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.

    How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.

    What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.

    Any help/suggestion/comment?

    Our bill would require every employer to attest that it is not displacing a U.S. worker by hiring an H-1B visa holder and that the employer has taken good-faith steps to recruit U.S. workers for the jobs in which an H-1B visa holder is being sought. Why would anyone oppose this measure? Our bill also gives more oversight and investigative authority to the Department of Labor. Right now the Department may only review labor certification for ``clear indication of fraud and misrepresentation.'' The Secretary of Labor is unable to review applications for anything but what the law calls incompleteness and cannot initiate an investigation unless requested. This means the Labor Department in effect is required to turn a blind eye to information that is suspicious. To remedy this problem, our bill provides the Department of Labor the ability to initiate an investigation on its own and gives the Department of Labor more time to review applications. The Department could also do random audits of any company that uses the program. Aside from these measures, our bill would prohibit employers to only advertise available jobs to H-1B visa holders. It would encourage information sharing between the Department of Labor and the Department of Homeland Security. It would double the penalties for employer noncompliance with the H-1B program requirements. I am happy to report that most of these commonsense solutions were included in the immigration bill. I challenge any of my colleagues to oppose these needed reforms before we talk about increasing the number of H-1B visas or at the very least in conjunction with that process. Today I take the floor to tell my colleagues that I am willing to work on this issue before the end of the year. I know businesses want more visas. I know groups that represent workers and visa holders want reforms. I know the American people want a sensible system in place that gives their children a chance at these highly skilled jobs. Some of my colleagues think the solution is increasing the annual cap on H-1B visas and doing nothing else. Before we agree to import more foreign workers, let's restore integrity in this H-1B program. The system needs a makeover. I am willing to consider an increase in the H-1B visa supply, but only if reforms are included. We must fix the loopholes before we just allow more foreign workers to come in and take jobs that Americans want to do. I would think my colleagues would want this program to work as it was intended by its original authors. My colleagues should want to protect the jobs of our various constituencies and help our businesses find the workers they truly need.

    Here is another question. Its about leadership but uses immigration as an example.

    "This is just one example of our political status quo: America's LEGAL immigration system is in dire need of a reform. Even though the members of Congress agree to that, they are not able to or not willing to bring about such a reform. Their hands are tied because of a certain powerful focus group who won't allow ANY immigration reform unless it encompasses a comprehensive reform of a well-known controversial issue. Innocent people always get hurt in a war. And in this conflict its the legal immigrants, who have not broken any laws, are the ones who are suffering the most. Senator Obama, as the President of the United States, what will you do, so that the voice of the people can be heard and their problems solved instead of selected powerful groups bullying the lawmakers?"

    Please vote. We need have people talking about our problems. We need to bring awareness about the difference between legal and illegal immigration. The likes of Dobbs often confuse the two.

    Point 1: We need to target news media here in the US primarily, not abroad. All good publicity is welcome, though. Please see a new thread started today by one of the moderators called "Ideas to increase Publicity of IV." There are key action items outlined there that every member can help out with.

    Point 2: What will be shared (and with whom) will be decided soon by the core group. We used to send out regular updates, but that has suffered lately because we are all volunteers and some volunteers who were in charge of it are tied down with other things at work and home.

    Point 3: We are already talking to people in academia and the academies.


    Point 4: No member is "discounted." All are welcome, but we really need non-paying members to start chipping in money. What people decide to contribute is their business, and entirely theirs. Whether it is $20 or $50 or $100 or $500...that is entirely the call of the individual. This activity is not cheap, rather it requires a steady cash flow. We are obligated under the laws to hire a CPA and everything will be handled and accounted for.

    First of all I commend your and everyone in putting their effort. I totally agree with you that we need more people and money. I think people are first to come and money will automatically follow.

    While word-of-mouth is effective we can augment this to get attention using other means:

    1. We can persuade news portals to advertise for our cause in a corner that might help us to get more people. Most Indians I know read Indian news everyday. If we can convince e.g., eenadu.net a telugu newspaper, to run ads we can get attention of lot people.

    2. Please start selling the current acheivements that are not confidential. Like you might have been successful in persuading a high profile senator about this problem. Put his quotes on our site and also possible grab attention from bloggers.

    3. If we can also tap academia who support skilled immigration that would help us. Let us put there studies in our reference section (I am assuming we didn't do this yet). This
    makes senator to reference our site and make their lives easy.

    4. Please do not discount freewill members who do not have a GC problem but savor
    helping others with immigration problem. It could be Americans or Immigrants we'll get them all in.

    I think these actions will help us grow our strength. I know it is easy said than done. I will send a mail to rediff and eenadu to put our banner on their frontpage. If anyone has contacts working for these website. That will make it whole lot easier.

    Sen. Charles Grassley (R., Iowa) apparently didn't read your "The Grassley Visa Tax "editorial of Nov. 2 ("Investing in America, Making Things Worse," letters to the editor, Nov. 8). His first two paragraphs made statements that were blatantly false. Spoken like a true politician.

    No successful business hires an H-1B visa holder just to fire an American worker. Because of the shortage of trained and competent workers, high tech workers are paid the prevailing wage rates. Sen. Grassley is overlooking the term of the H-1B visas. No business wants to train a worker who will leave in a short time. Successful businesses are built on the expertise of long term experienced workers. H-1B workers are attractive because there are not skilled Americans available.

    Sen. Grassley should consider the interests of the country as a whole instead of pandering to special interests and he should consider legislation to improve the performance of Americans instead of making false accusations to polish his image.
