My attorney received the RFE yesterday (just under a week after the email notification) (and I haven't received anything directly yet).
They wanted copies of the original I-485 and G325A forms (for both my wife and me), filed in Aug. '07, signed again.
Nothing changed or updated, just our signatures above the "signatures" the attorney/representative put in the original forms for us, in 2007.
Hopefully this is all they want and not more once they receive this...fingers crossed, not holding breath! :)

Friends, I already have expressed the views regarding Recapturing/ temporarily increasing Employment Based Visa Numbers for Greencard, on change.gov website . I have been getting E-mails from Transition Team. I have pasted this recent E-mail which is about Meeting with Transition Team. I think, IV Core Team members or/and people living around Chicago area should arrange meeting with Transition Team, and express and suggest our ideas regarding Recapture/Temporary Increase EB greencard Numbers to clear the backlog.

To me; it looks like it could be a shift in change of policy. In the denial notice; it is the same officer number who sent the notice of intent to deny. Therefore; it is not a training issue; looks like something else is happening.
training issue is when they send straght denial after 140 is revoked.

So coming back to Immigration (which is what, I believe, we are discussing), below is what I came across on congress.gov.
The Supreme Court has ruled that the Congressional power to regulate naturalization, from Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]
In other words, the Constitution does not specifically mention immigration but based on the above, delegates power to the Congress to pass laws to regulate immigration. This Article of the Constitution also clarifies the part about rules for immigrants and quotas being set at the Federal level and not State level.
The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.
There are far too many points here to address at one go. Let me touch upon this for starters:

Clause 4: To establish an uniform Rule of Naturalization
Are we disputing the fact that congress has the power to establish a uniform rule of naturalization?
No. We are not. We are just saying, that the current Rule of Naturalization is in violation of the discrimination clause in the constitution, and ought to be disregarded. We are not asking to strip congress of this power, so this argument you make is not relevant. Agreed?

I mostly get reds for being honest and stating the facts but that doesnt matter. I have to agree with Nathan, dont get emotional, lets see how to get out of this mess. As you stated, your employer didnt invite you, the only thing he should have done that he didnt do was recalled your petition when it became effective. He will get away with a warning and a small fine unless he has done the same as a pattern.
You can get him in real trouble, (of course but only by doing damage to yourself) by proving you paid the money for the H-1 and I sure here too, you would have given him a check and he would have given a company check to USCIS and you are going to make life more difficult for you than for him as proving you paid the money for the petitionis going to be very difficult.
This is the time to sit back and think what is your real goal. I guess, it was to come here and work hard and succeed not make life miserable for everyone involved. Trust me Honey attracts more flies than vinegar. Speak to your employers softly and try to find a solution. If you need help finding a job, I am sure there are plenty of avenues, especially with the market improving.
Now dont jump into conclusions, that I am another consultant or work for a consultant. I am neither.

SBI....
I used ICICI for 7 years....was always ok with the serivce ...did not have anything much to complain....
I did not know about SBI service being available....a few days back someone on IV forum told me to try SBI....I tried it out....
If ICICI charged me 50 paise per dollor SBI charged only 25 paise per dollor....(come one it is not free with anyone... -;)
I used SBI twice so far.....quite happy.....more over feel glad to use a nationalised bank -:)
compared to ICICI ...on a different note....my wife opened an NRI account with ICICI 5 years back and since then I have been trying to add myself as a joint acount holder....starngely ICICI's "excellent" customer service has not yet been able to do it....:confused:....I might as well give up....lol...

Lets ask Core not to just go with the temporary fix of July visa bulliten.
We might apply for EAD and AP but what if they throw our papers some where and repeat the same thing.
This time they will be very careful in issuing visa bulliten
In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...

This time they will be very careful in issuing visa bulliten
In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...

We should be firm with our goals...

When some one first suggested flower campaign everyone took it as a joke...it was not implemented before some one sent the flowers and showed the receipt number...

My idea ...lets not just accept the temporary fix...we should fight the congress until they come up with a plan of fixing the GC issue.
The congress talks about fixing illegal immigration..Lets ask them to fix the legal immigration first.
Unless we are really strong about it...nothing can be accomplished..
They cant fix the existing legal system but they are ready with the plans of fixing illegal immigration...of course it failed but still they had big impact...
Dude, good to see your energy. But, I am not sure how long you have been following IV. Applying for 485 is only part of the IV agenda. Read the home page.
