Hi
Here is my situation and looking for any previous experience and suggestion from experts.
I have my EAD valid for 2 years PD 05 EB2. I got a job from another company but vendor says I need to be in his payroll. Job wise everything is good. I want to join him on EAD.
Here are my concerns
1. Should file for AC21 or just keep quite till CIS sends a letter ?
2. If I ensure my new job and old job responsibilities are same, am I safe ?
Do you see any problems or advise me for anything.

My lawyer says i can join company B as soon as USCIS has received my application for H1B transfer? is this true or do we have to wait for receipt number/case number?
I need to know this because my company will not file I-485 until i join them but under the current backlog CSC is having a huge backlog with receipting H1B transfer cases.
Please help

I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)
Do I need to worry about this? any advice/suggetion?

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

I agree that an error in name order on an EAD is not likely to cause any major problems. However, You can apply for a replacement card by filing another I-765. If the error on the EAD is due to a USCIS mistake, no fee is required. However, if you caused the error by providing incorrect information, then you will have to pay the full $340 filing fee again.

If your lawyer or you can get through to a person at BEC maybe you could get that person would agree to accept mail addressed to a specific person at the BEC, that way there would be someone to contact to check that they have it.
Obviously they wouldn't normally do that, but if someone there believes the lawyer that it was lost twice then they might take pitty.
That way you are dealing with someone rather than a black box.

I will be going for H1B stamping in feb/March at Mumbai Consulate.
In 2001 my F1 visa got rejected 3 times because I showed that I have sister in USA.
My sister is in still in USA. Now while taking H1B appointment in form I have again to mention yes or no (for the Que do you have any relatives in USA)
What I should do? What will be the effect if I said No? Do you think, VO will ask me that your F1 got rejected because you had sister in USA? So now did she came back?
Please reply me ASAP.

As far as i know no us consulate has right to reject H1b unless u have fasle docs or involved in wrong activities. Also DO NOT GIVE/WRITE any FALSE information about you to them or in other words DO NOT LIE to them .
F1 rejection has NO baring on H1b.

My mother came for a 6 months visit on December 10th of 2010. But she left in April of 2011 (April 9th 2011), two months short of her 6 month's stay. Can she come again in August 2011 for a six month's stay, and stay till Feb 2012? Or will she have to return in 2 months? (return by October 2011)

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.

My fianc�e lives in Mexico and I live in the United States. We are planning on getting married this summer. As soon as I return, I'm planning on beginning the process so that my future wife could come to the United States to live with me. We plan on getting married in the Catholic Church, but we have doubts if that type of marriage is a valid one for this specific situation. We just don't want a delay in the process simply because it was a religious marriage and we want to be with each other as soon as possible.
