Just look at US companies and universities are unable to freely deploy and redeploy high skill knowledge workers that can help them meet the organizations' economic objectives and US competiteveness interests! Knowledge work knows no national boundaries. Preserve high skill work within the US regardless of workers' country of origin and help preserve high tax and social security contribution within the US!
B. CAPITALISM & FREE MARKETS - Will a democracy like America support the notion that 'indentured servitude' by highly skilled labor is acceptable in a nation of the 'brave and free' where notions of indentured servitude was outlawed in the 20th century?
HARD TO BELIEVE? Just look at highly skilled professionals with H1B's stuck in companies and jobs for *years* with uncertainty where they cannot freely participate in the economic development and progress of this country. They are, for all practical purposes, tied to the yoke until their Green Cards are available. They are indentured labor because of retrogression and backlogs with visa numbers.
C. HUMAN RIGHTS & WOMEN RIGHTS - Will a leading Human Rights supporter like America support the notion that 'women should be forced to sit at home' only because they are spouses of highly skilled labor and hence have to be 'forced to have babies because they are on a H4'?
HARD TO BELIEVE? Just look at wives of H1B workers, many with advanced education and work experience, stuck at home and at risk for social, psychological and physiological degradation and abuse only because they are trapped within the 4 walls and cannot participate freely in the land of opportunity and hard work? They are, for all practical purposes, subject to the restrictions of the Middle-Ages women/wives that were forced out of opportunity and development.
It is EASY for us to get misled by hype and hyperbole when talking about immigration. For a land built by immigration, the very title cannot and should not become a lightening rod!
Respected elected official, I urge you, beg you, beseech of you to please consider the net-economic value and social value that we, the highly skilled LEGAL immigrant workforce continue to bring to the USA.

Ascetic, EBX-Man are right, you need affidavits in those situations.
Get the affidavit in a non-judicial Bond paper sworn and attested before a notary public from both Parents, that should be sufficient, you do need to go to a magistrate.

Keep in mind the consequences of the new bill. Any I-140s filed after May 21 (or 15 depends where you are reading) will be invalidated. If I was you and my PD is current, I would take the risk and hang in there, get I-485 filed and bite the bullet for 6 months or 1 year (again depending on how the bill turns out)

I filed Concurrently I485 and I140 on August 13 . I have recieved the application rejected notice due to missing signatures on the financial statement by my employer (Hard luck i guess or smartness by employer dont know). As per USCIS statetment they have requested to complete the Application as signed and sent back including the fee and form.
The notice havent mentioned to refile with new fee . COuld anyone please advise on urgent basis
if new fees is required ?
Would i still be assigned old processing date or it would be considered as new application ?

Stock options work like this
If a company gives you 100 shares at 10$ each that means you have the option to buy them by the expiry date at 10$ each.
So if within the expiry date they reach to 15$ you can buy them at 10$ and sell at 15$ getting a net profit of 5$ per share ( 500$ )
In your case the share price is below what you will have to buy the shares at . So no use. You will be losing money in case you decide to sell them.
Although if you think the share price is going to rise in the future you can buy them and hold them long term until the share price rises above 30 and you make some good money .

Is it legal to work overtime when you are on H1B? I have been working more than 40 hours a week ever since I got my H1B (about 5 hours overtime per week on average). They pay me time and half for the hours over 40.
The reason I ask is that I need to send a couple of paystubs as my parents are travelling to the US soon and I do not want the guy at the port of entry make a bid deal of my overtime hours (if he looks at it and finds out, which I doubt).
The person that stamps your passport and I-94 at the port of entry, is he an immigration officer or who is he? I am writing a letter for my parents to carry with them to show that person if asked for it and not sure who to address the letter. Thanks.

I am afraid the DreamAct folks will just again dig their own graves. That record number will just prove that the change.gov effort is a system which may not attend necessarily needs of Americans, but rather the will of anyone including foreign nationals and illegal aliens. Sorry, just wanted to share a honest reality.

Hi everyone:
I have an unusual situation concerning my friend's mother. When he got his green card (about 10 years ago) he filed the green card application for his mother that lived (and still lives) abroad, hoping to alleviate the woes of her getting a short-term traveller's visa every time she traveled to see him.
She received her green card about 4 years ago, but she doesn't want to live in the US for more than a month. Unfortunately it also gets more and more expensive for them to make her travel to US every year, thus pushing her into a violation of her Permanent Resident status and of the recurring Re-entry Permits (that now shrank to a single year).
My friend now wants to suggest his mother to relinquish (i.e. give up) her permanent status but his fear is that once done she will not be able to return back to US to visit him. (He has already become a citizen and is not planning to return to his home country.)
Does anyone here have any suggestions of what could happen if she gives up her permanent resident status?
Cousin went through same situation recently (early 2008). Parents "surrendered" their GC's, to Mumbai consulate general office, and simultaneously applied (same day same time while in the consulate) for Visitor VISA (they were advised about the procedure by Mumbai consulate office via phone, they had called them couple of months before doing this). Visitor VISA was granted without any questions asked.
My parents are thinking of doing the same very soon.

Hi, I have a quite strange situation here:
I am from China. I have an approved EB2-NIW I-140 with priority date of 2/2008 and an EB1a 140 petition denied on 8/4/2010.
I filed an I-485 concurrently with my EB1a, along with EAD applications. I got my EAD on 11/2009 and used it to work already.
The strange part is, my I-485 case is still pending, even though my EB1a petition is denied. In fact, I received RFE for quality photos two weeks after my 140 was denied. I think this is a USCIS error because they think my 485 was linked to my EB2-NIW case.
Now, am I staying in the U.S. illegally even though technically my 485 petition is still pending?

Hello Friends,
My current passport is expiring in Jun 07. I have applied for passport renewal at Indian Embassy (Washington D.C.) in 3rd week of Jan 07 via courier. I may have to travel urgently to India by end of this month. Just wondering if anyone recently got their passport renewed at DC and what was the duration. It will help me to take the decision about departure date. Unfortunately DC is 5 hours drive from where I live. I am not sure even if take a day off and drive to DC to collect the passport they will even give it to me on the same day. Multiple attempts to contact DC office via phone/email were not helpful. No one picks the phone and their voice mail system is always full. Any advise on what I should to do know status of my passport renewal would be appreciated.

asked him if Senator Coryn supports displacing well-educated American
workers with Foreign H-1B Visa holders. He immediately passed me off to a

people end up staying here -)
Of course the staffer did not pick up his phone - but the staffer's name is

Maybe you all have different information that I just obtained from both
Senator Pete Domenici's office (Republican) and Senator Jeff Bingaman's
office (Democrat) -- both of New Mexico. But both of their offices claim
that Skil Bill "Access to High Skilled Foreign Workers" S 2691 has NOT left
committee yet and thus cannot be voted on yet. (It is certainly possible
that you all have different or better information than was conveyed to me
but this is what I obtained.)
Domenici's office staff person couldn't tell me which side of the fence he
was on as he hasn't "made a press release" yet. And, as long as it is in
committee he apparently doesn't voice an opinion.
Senator Bingaman's office staff also told me that he had not expressed an

say it was UNlikely.
Finally, when I got to the staff woman in DC she was a bit surprised
because someone had called her on the bill from one of the Senator's New
Mexico offices. (A bit strange unless it was my calling the Senator's 800
number which connected me some place in New Mexico and they called the DC
office for information regarding my inquiry.)
(BE careful when you call, however, one Bingaman's staff males that I
spoke with tried to give me the WRONG Senate Bill number reference. He
asked "This is Senate Bill 2626?" I said "The one I am calling on is
"Senate Bill 2691 "Access to High Skilled Foreign Workers" so unless the
bill has been reassigned a number that I don't know about -- I am calling
on the Skil Bill "Access to High Skilled Foreign Workers.")
Oh, yeah! the woman from Bingaman's office said "Oh, THAT's a
Republican sponsored bill!"

I, too, phoned Cornyn's office and the person I spoke with kept insisting
that the H-1B's had to be paid the same as Americans and then he said the
senator wants to make America more competitive by bringing in skilled
workers. I directed him to Norm's article in the San Francisco paper and to
the Programmers Guild. I asked him how it would make our nation more
competetive to bring in a worldwide supply of cheaper labor to take our
jobs. Silence.

I called Cornyn's office just now - male staffer got really annoyed when I
asked him if Senator Coryn supports displacing well-educated American
workers with Foreign H-1B Visa holders. He immediately passed me off to a
voice mail box of a staffer who handles immigration matters. (Yes, I know
H-1B's are so-called "non-immigrant Visas" but we all know most of these
people end up staying here -)
Of course the staffer did not pick up his phone - but the staffer's name is
Landon Bell. Why not ring up Senator Corn-Hole's office and ask for Landon
Bell, and ring Landon's bell a bit?

I called Cornyn's office just now - stated my opposition of course. The
person I spoke with said that Cornyn was trying to get his bill introduced
today, and he was not sure if it would be voted on today.
Hopefully Cornyn fails. I think he is getting our message, but I also
think he does not care.

Maybe you all have different information that I just obtained from both
Senator Pete Domenici's office (Republican) and Senator Jeff Bingaman's
office (Democrat) -- both of New Mexico. But both of their offices claim
that Skil Bill "Access to High Skilled Foreign Workers" S 2691 has NOT left
committee yet and thus cannot be voted on yet. (It is certainly possible
that you all have different or better information than was conveyed to me
but this is what I obtained.)
Domenici's office staff person couldn't tell me which side of the fence he
was on as he hasn't "made a press release" yet. And, as long as it is in
committee he apparently doesn't voice an opinion.
Senator Bingaman's office staff also told me that he had not expressed an

If per country limit of 7% stays, how much relief would it bring in terms of
priority dates for India/China born individuals?
I do not think there shall be any significant positive movement in Priority dates. Even if annual numbers go to 290K from 140K and dependents are excluded. It is about 4 times meaning if earlier we had 10K for India including sposes meaning 5K effectively, now it will be appx 20K effectively!
Think of number of applicants from India and China and think of the flood coming when all backlog is cleared! I dont think we should expect big jump in priority dates.
