I couldn`t reply any sooner.I was busy with Open house( a whole lot of scrubbing and cleaning).
I cannot post the contents of the RFE`s as most of the info is private and not appropriate for the public forum.But the info I got from the forum so far has been helpful.
What we are trying to do now is to get appointments with atleast 2 other attorneys(murthy and khanna) .our current Lawyer responded to our questions on a sunday .Not many lawyers do that. and we have only 2 weeks to respond Once we get some answers we`ll go from there.
Our case is very complex.I don`t want other members be discouraged by the amount of papers uscis requested.Not every one gets this unlucky.They asked for all w2`s,first and last paystubs with each employer and federal tax returns.Rule of thumb don`t discard any paper that you ever submitted to uscis and all your employment records.
I will keep you posted.

Dunno man.....them people are raising their kids to be terrorists....i am worried what they would do to innocent people when they grow up. I am from bombay -- and actually we had more fun in the buildings / apartments because you end up spending more time outdoors with friends.
I agree with you. But not all the people have the same luxury here as you may or may not see an apartment fills with people you look for and who can stay for a while at the same place, except bay area and couple of other areas filled up nationals of same countries. But surely not all over the country.
So it is not a bad thing to move to a community if you find all in one place.
Ofcourse, this is not to force everyone to buy a home and practically that is not possible.
This is for someone who knows that he has plans to go with the current company for sometime and ready to buy a home, but just waiting, waiting and waiting........ for GC to do that.

Will 115k enough by seeing 133k applications in one day? If 115k is reached we will ask unlimited. So there should be some system to see whether those115k H1b is used properly. Employers should not wait till october and they should get people when they require. If most of the H1b quota is used by bodyshoppers where will top US companies get?
One possible solution is to establish a separate quotas for companies perfoming R&D in the US. Something like this already exists in the tax code where companies establish eligibility for the R&D tax credit. A similar bar could be used to administer a R&D quota for H1B or GC. That should address concerns around the quota for top US companies.

And let me add another twist to the story.
The Guy with Masters degree is working with a desi sweatshop and convinced his masters (No pun) to file for Eb2 even though his job duties were just dish out code like a high school grad can do. On the other hand there was another guy who was in US for a decade , gone though masters degree and got a very good job in a very good company. He was eligible for EB2 but his only mistake was to not force the company to file a EB2 case or even worse his lawyer makes a mistake and files under Eb3 even though the job he was in and he are qualified as Eb2. The company wants to make amends now by filing a EB2 case and first MS guy (sweatshop guy) wants him to start again and wait for another decade.
The kicker : The sweat shop labor guy works in the same company as contractor and reports to the second guy and in the same reporting chain, just two levels below him.
How about another story :
Both guys go to the same engg school back home. One guy passed with distinction and got a job immediately in a respectable company immediately. Other guy takes two additional years to finish the degree , but his dad was rich enough to send him to the US to complete the MS and now he thinks he is smarter than every one else and needs a special place in the queue.
You can come up with 100s of stories if not more. Therefore you can't generalize. Just don't think all those who filed under EB2 first are with MS and smarter than others and all those who are Eb3 are here by shady means.
I am not taking sides here, but it is not a question of "smarter". I have a simple question. Do years spent doing MS/PhD have no value? They count for nothing in PD. On the other hand a person with a BS accumulates 5 years in the same time and ports. Now he/she is a full 5 years ahead of the one that pursued the education route. Fair?
I don't think that porting is all fair. Just MHO that the 5 year experience rule negates all efforts in getting a masters degree/PhD and puts those people at a huge disadvantage. The system tried to make up for that by creating preference categories. Not that they work perfectly of course as many of you have pointed out.
So let me come to the point, question for OP. Are you against all porting? Or only against porting based on lack of qualifications for an EB2 job originally- then porting 5 years later based on the additional experience alone?
BTW I resent the insinuation that 1% of EB2s are genuine. The same can be said of many many EB3s- remember the qualifications required are much lower.
I also resent the idea that all US Masters folks are just "rich kids". Most people work through the degree and/or take loans. Please don't start making needless statements. If you had a masters originally and your job qualified as EB2 but your company refused- I feel for you, I really do. There should be a solution to your problem. That does not mean that those who did get EB2 were all suddenly not "genuine".

Because the dissident and his family were not permitted to attend the ceremony, the prize was placed on an empty chair, a potent symbol of the oppressive nature of the Communist Party; in short, a diplomatic disaster.
The relentless pursuit of Mr Khodorkovsky has likewise further tarnished Russia's image. The former head of the oil company Yukos is likely to be sentenced to a six-year term this week for embezzlement and money-laundering, shortly before he completes an earlier, eight-year sentence for tax evasion. The charge that he stole �16.3 billion of oil revenues between 1998 and 2003 is absurd. And the political nature of the case has been made crystal clear by Vladimir Putin, the prime minister, who said earlier this month that "a thief must sit in jail". Mr Khodorkovsky's cardinal sin, in Mr Putin's eyes, is to have provided funding to opposition parties. His second sentence will mean he will be out of the way well beyond the presidential election scheduled for March 2012.
These two men are being hounded because they challenge the status quo, which in China is the political monopoly of the Communist Party, and in Russia, bureaucratic cronyism. In both countries, those who have grown rich and powerful under such conditions want to keep things as they are. Yet the very intensity of the persecution reveals a fear at the heart of each system that its authority is more fragile than it might appear. Does the emperor have any clothes?

The h1b system was designed to create brain drain in developing nations and bring them to America, but because of the implementation methodologies the opposite is happening, good people are either moving back or not coming or stuck with an employer which is not good for the economy.
America gains nothing by banning h1b people - I am sure some provision will be there to protect people and get a fair chance towards imigration even if consulting etc.. practices are modified to work in correct methodologies.

However, you are in a situation where most of intellectual muslims today find themselve. When your rulers are hurting other nations they will take their retalliation on whole country irrespective of whom they are killing. Unfortunately all terrorist use civilians to hide their lack of guts and courage and never confront their enemies with open war where only they alone fights them.
People have to bear the burden of their decision of electing terrorists as their leader and when such leaders do not act against terrorist country suffer. Ultimately this will happen everywhere in the world. We may have to witness more often in future this type of situation where victim country will attach muslim country from where terrorist attaks. Half a dozen freshman Democrats took to the House floor one late-October morning to cast their lot with Republicans.
Their actions went unpunished by the Democratic leadership that day, as they have on many other occasions in recent weeks. The symbolic gesture -- casting nay votes on approving the House Journal, essentially the minutes of the previous day -- would have no bearing on the leadership's agenda.
While they overwhelmingly support that agenda, the bloc of freshmen has begun casting votes against such minor procedural motions in an effort, Democratic sources and Republican critics say, to demonstrate their independence from their leadership. The number of votes that the potentially vulnerable newcomers to Capitol Hill cast against House leaders is tallied and watched closely by interest groups and political foes.
Such is the political life of many of the 42 freshman House Democrats, a sizable number of them moderates and conservatives who must straddle the fence between supporting their party's interests and distancing themselves from a mostly liberal leadership as they gear up for their first reelection battle next fall.
House Speaker Nancy Pelosi (D-Calif.) and other members of the party's leadership are happy to tolerate the independence on procedural matters. Less than three hours after opposing the late-October journal vote, the same six freshmen sided with Pelosi as Democrats tried, and failed, to override President Bush's veto of a bill to expand the State Children's Health Insurance Program by $35 billion over five years, legislation that Pelosi has called her "crown jewel."
"I'm viewed as an independent. I'm viewed as a conservative Democrat," said Rep. Jason Altmire (Pa.), the first freshman to regularly oppose his party's leadership on the journal vote.
Like several others, Altmire offered no explanation for voting against all but one of 18 roll calls on the routine measure, adding that he had no "pre-planned" rationale for the votes. "I'm certainly not going to win or lose my reelection based on my journal votes," he said.
But the first reelection campaign in his conservative-leaning western Pennsylvania district could be a tough one. Bush won there by a comfortable nine percentage points in 2004. Districts such as Altmire's fueled the Democratic takeover of the House last year. They are blue-collar in attitude and red-hued in politics, particularly on issues such as abortion and gun rights.
Dubbed the "majority makers" by Pelosi's leadership team, the freshmen have become a major front in the Democrats' battle to sustain and expand their majority next fall.
Stuart Rothenberg, an independent analyst and author of the Rothenberg Political Report, said Republican hopes for shrinking the Democratic majority begin with what he calls "snapback candidates," who rode into office under the last election cycle's optimal conditions for Democrats and now face their first reelection contests.
Protecting the 42 freshman Democrats, the largest partisan class since 73 Republicans took office in 1994, has been the top priority for key Democratic strategists such as Rep. Rahm Emanuel (Ill.). The freshmen get special treatment from leaders, including a weekly meeting with Pelosi and Majority Leader Steny H. Hoyer (Md.). And they receive frequent advice on how to vote from Emanuel and Rep. Chris Van Hollen (Md.), chairman of the Democratic Congressional Campaign Committee.
Seven of the rookies have more than $1 million in cash on hand, and according to Rothenberg, more than half are in safe positions to win reelection. In addition, the Democratic Congressional Campaign Committee holds a more than 11-to-1 cash advantage over its Republican counterpart, a potential financial backstop for endangered freshmen.
But the political environment has turned toxic in recent months as Democrats have been stymied in their effort to take Congress in their self-proclaimed new direction. Opinion polls show public approval ratings for Congress mired in the 20s, considerably lower than Bush's rating.
In recent months, Democrats in battleground districts have been criticized by Republicans, who have tried to paint them as close to the new House leadership.
"While these Democrats might claim to be independent voices for their districts, the differences between them and Nancy Pelosi are purely aesthetic," said Ken Spain, spokesman for the National Republican Congressional Committee. This year, the GOP committee launched a Web site to track the percentage of votes that 28 of the freshmen cast with Pelosi, whom Republicans say will be a polarizing figure in conservative districts next fall.
That is why procedural votes are important to freshmen, according to Democratic aides. House Republicans this year turned to a procedure known as a "motion to recommit," offering what is typically a routine method of sending bills back to committee as politically charged amendments. With a wink and a nod from Emanuel and Hoyer, some endangered freshmen frequently vote with Republicans on tricky GOP motions to keep their votes from being used against them in 30-second campaign sound bites.
Some freshman Democrats have taken the idea of voting against their party leadership on procedural votes one step further, opposing mundane matters such as the journal vote.
Altmire has sided with the opposition in 17 of 18 journal roll calls this year. Rep. Joe Donnelly (D-Ind.) has cast 15 votes with the GOP. In the spring, only a few freshmen voted against the journal, but one recent vote drew 13 freshmen in opposition, and in another, 11 voted nay. Now a half-dozen or more regularly oppose whenever a roll call is held.
Democratic leaders acknowledge that they have encouraged the freshmen to sometimes vote with Republicans on politically difficult issues, but deny that they have had any input on the Congressional Record votes.
"We've given them very simple advice: Make sure you vote your district," Van Hollen said.
As a result, Rep. Heath Shuler (D-N.C.), for example, has one of the lowest party-unity voting scores -- less than 84 percent -- of any House Democrat, according to washingtonpost.com's congressional database. The average House Democrat has voted with the majority on 92.5 percent of all votes.
"They're trying to create separation. Our guys did it in '95 and '96," said Rep. Thomas M. Davis III (R-Va.), a member of the GOP class of 1994.
At the time, freshman Republicans saw congressional popularity plummet during a budget fight that led to a series of federal government shutdowns. In modern times, wars between nations are not started in days or weeks. Wars are not based on one event. There is a systematic three stage process to go to war and for a nation to convince the majority of the society/nation that the other guy is pure evil and your mortal enemy. Society in Pakistan is based on their haterade towards Indians. For many years children in Pakistan were taught that Indians are evil, their belief system is barbaric, and their existence means that Islam is in danger. That was the reason some of us saw posts on this forum talking about sati system in Hinduism or some others Pakistanis saying that Hindus are attacking Muslims in India, and then other Pakistanis talking about Modi, VHP and Bajrang Dal. The first step for creating a war involves propaganda within the population of the country that your enemy is evil. Pakistan has been doing this preparation very systematically for sometime.
Second stage to go to war involves finding a reason after the decision has been made to go to war. In this stage, one has to come up with a reason and then waits for the trigger to create the reason to go to war.
The third and final stage to go to war involves invoking the trigger, which will create a flash point for the war, and so the war begins. Mumabi was that trigger.
The reason why I am saying this is, because someone wrote on this form "don't be a war monger". You see, we are not creating a war. The war is being forced on us. To defend oneself is not "war mongering". Our willingness to live in peace and harmony should not become our weakness such that someone openly and deliberately attacks the population of our country. There is only one way to reply to such attacks. Respond swiftly and with full force. Personally, I believe that 30 days is too late to respond. I believe that response has to come before the ashes of the dead is still hot. Otherwise, justice hasn't served, because justice delayed is justice denied.

Too much thinking, weighing too many pros and cons creates confusion. When you are confused, you don't act. When you don't act, a fresh wave of terrorist attacks comes in. Terrorists are everywhere - temples, hotels, buses, trains - even your senate (parliament). Then you catch some terrorists .
Ok, so you caught the one that attacked your parliament. There is a clear evidence, yet the questions remain.
Should I hang them or should I not hang them?
If I hang them, will they be martyrs? So what should I do with them? Should I feed them dal chawal or should I feel them dal roti? Ok, now Mufti's daughter is kidnapped, so should I release them, should I not release them?
You still keep scratching your head. What should I do? Should I do this or should I do that? Pakistan is a nuclear power. Gilani keeps chanting that like mantra, what if there is nuclear war? What if it destabilizes the country further? why not let Pakistan die its own death - its a failed state (no sir, it may be a failed state but there are managing to get all the aid in the world, China is helping them, America is helping them, IMF is helping them, Asia Bank is helping them..they are not going to die anytime, they are walking away scot-free but they are slowly killing you, eating your house like termites - wake up and realize that!!)
If you have roaches in your house or you have vermin in your farms, do you keep thinking what you should do about them? Exterminate them. Does it mean the roaches will go away? Probably not. But you do your job first and raise questions later. If they come in, you kill them again. you do your job and keep doing it.

Second stage to go to war involves finding a reason after the decision has been made to go to war. In this stage, one has to come up with a reason and then waits for the trigger to create the reason to go to war.
The third and final stage to go to war involves invoking the trigger, which will create a flash point for the war, and so the war begins. Mumabi was that trigger.
The reason why I am saying this is, because someone wrote on this form "don't be a war monger". You see, we are not creating a war. The war is being forced on us. To defend oneself is not "war mongering". Our willingness to live in peace and harmony should not become our weakness such that someone openly and deliberately attacks the population of our country. I do not hold any false sense of myth of nationalism hosting the flag. But when war is forced upon us, there is no way we can run away from it.
For a moment, just imagine, what would have happened if Mumbai attacks were done in China as "Beijing attack", or if Pakistani terrorists would have attacked Iran and they were "Tehran attack" or for that matter an attack on any country in Europe or say US. You already have I-94 valid until 11/11/2209.
Just to verify, are the numbers same on both I-94s (8/11/2007, 11/11/2009)? If so, you are ok. Staple the new I-94 in the passport along with the old one.

I have changed the H1b after my last entry to usa. My I-94 in passport and in the H1b approval notice numbers are not same. Out of all 10 digits only 6th digit is different. I think it is a typo by uscis. What should I do?? The difference is very hard to figure out that I noticed it only when I was filling out I-485 by myself.
Any suggestions

I am on H1B and I485 is pending. I just bought a mid-price house and I will recommend to buy only if your I140 is approved. I waited for many years but finally bought one. Buying the house was a big decision but I am glad that I took it. I have a 3 year old daughter and she being able to run in our own backyard is worh of some financial risk. The house prices are lower (still I think a little higher than it should be) and the interest rate is good too. So, go for it and good luck.

The market is crashing because the house prices are so much inflated that people are not buying. This is why you see record foreclosures. Infact some of them sold at the height of the bubble and made large profits and are now renting. They are waiting for the market to fall further. This whole market is a ponzi scheme with flippers buying and selling each other.
