To retain the PD, you would need the copy of the I140. Without that, there isn't much that can be done when you switch companies to keep your PD.

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

AFAIK L1 counts towards that 6. So if you have done 1 on L1, 2 on H1, then you have 3 more years left on H1

I have been in H-1B status for 4+ years. This year, I started attending full time college and had applied for transfer of status from H-1B to F-1. However, my application is still pending with USCIS. Since I need to travel home urgently, I was wondering what steps should I take before leaving so that my status is not affected. Because if I travel abroad, I will be applying for new F-1 at a US consulate, do I need to cancel my application with USCIS here before leaving? Are there any consequences of keeping my application pending here.
Any advice is very much appreciated.

My background:
1. Got Ph.D three years ago
2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.
Now I am preparing files and will apply as EB-1b.
can you tell me the best points to claim?
I will tell you any progress in the coming days. Thanks forum friends.

I am a July 19th filer and I have not received my receipts. I checked with my lawyer yesterday and they have not received either. Since my lawyer issued all the checks I have no idea whether my checks are cleared or not. So here is my question. How long will it take for the actual reciept after the check clearance.

I was working with company A and got approved I140(1 year back) after that I moved to company B using approved I140 and got 3 yrs H1B extension.After that during July,07 period I requested company A to apply EAD and i485(Company A mentioned as future employment).Now I am still with company B.
But now Company A asking me to come back.Since I have everything approved (i140) except i485(pending) do I need to go back to company A?
If I do not go to company A,can he cancel approved I140 ?
Need help/suggestion .

Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. My question is what is the better option out of the following to change employer:
1. To transfer H1B to new company with the same Job Title as was in previous H1B. I have good relation with my existing employer.
2. Or I can invoke AC21 and start working on EAD with new employer (after 180 days).
Questions:
Q1: If I want, can I come back to my existing employer on same old H1B (if thats still valid) ?
Q2: I frequently go to India (at-least one time in a year). So with EAD and AP, there might be more waiting/ filing each year etc.
Q3: Which is the better option for me - H1B or EAD ?

If you go to the USCIS website (www.uscis.gov) you can download the EAD application and the list of documents that you are required to submit. My understanding is that the location where you file your EAD is dependent on the State where you live. The EAd application instructions include information on where to file depending on the State where you live.

Hi everyone, I applied for H1B last year and my employer said my application was not selected in lottery. This year a different employer is applying for my H1 and the lawyer today told me that I already have an approval and gave me a receipt no. When I checked its status online, its - 'Approval notice sent on 29th August 2007'.
I wonder how this lawyer is saying this is my approval, eventhough I was told by my employer last year that I didn't made through lottery. And now this lawyer is asking for the copy of that approval which I am not at all aware of. If I knew I already have the approval I wouldn't be applying again this year.
How did this lawyer found out about my approval receipt? Is there a provision for them to check? Will it be illegal if my application goes again, with an existing approval. I have never been to USA.
Please suggest, what should I do.

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?
